The GCS apply between you, as a consumer and not a professional, and us, the company Léane Jacquot, whose registered office is located at “1 rue Eugène Sue 93360” , registered in the Bobigny Trade and Companies Register. Please note that these terms and conditions are subject to change, as we reserve the right to modify them at any time in accordance with changes to the Site and/or regulations. We wish to make it clear that the terms and conditions in force at the time you place your order will apply to you.

1. YOUR CUSTOMER ACCOUNT

In order to order on our Site, you can create a customer account via the “Create an account” section or place an order without creating a customer account, as a guest.
Creating an account allows you to :
– enter your personal details to make future purchases easier;
– consult, modify and update your personal information;
– identify yourself before placing an order;
– track your current orders and view invoices for past orders.
If you order as a guest, you will have access to the tracking of your order by email or via the “Track my order” page, which can be consulted on our Site with your order number.
By ordering on our Site, you confirm that you are a private individual, and that you are purchasing our products for personal use in quantities corresponding to the usual needs of a consumer’s household. Under no circumstances may our Site be used by professional “customers”. We reserve the right to refuse any order that is clearly validated by a professional customer.
You are responsible for maintaining the confidentiality of your customer account and password, and for restricting access to your computer or other equipment. As such, you acknowledge that you are responsible for all activities that occur under your customer account. If you suspect that your customer account is being used by a third party, we recommend that you change your password and contact us to close the usurped customer account, if necessary.

2. HOW TO ORDER ON OUR SITE

You can order your favorite items directly from our website.
Product offers and prices are valid as long as they are visible on the Site, while stocks last. In the case of special offers, the duration of the offer will be indicated on the Site and in our newsletters. It may happen that our products are temporarily unavailable, and you will be informed of this on the product sheet.
Ordering is simple!

– Select your items, size and personalization options and add them to the shopping cart. You can check the number of items in your basket at any time, and obtain detailed information on each item by clicking on “Basket”. Once you’ve added an item to your basket, you can continue shopping by clicking on “Continue shopping”;

– Once you have finished shopping, click on “Finalize my order”;

– Log in to your customer account, create an account if you don’t already have one, or continue as a guest;

– Choose your preferred delivery method and fill in your delivery address;

– Choose your payment method, read and accept the full terms and conditions and proceed to secure payment of your order. Payment of your order implies full acceptance of these terms and conditions;

– Your order is confirmed! You will receive an email confirming your order.
By placing an order, you declare that you are at least 18 years old and that you have legal capacity (or if you are a minor, that you have parental authorization to place your order).
If you have placed your order as a guest, you will need to fill in the information requested on the “Order tracking” page on our site, together with your order number. After this time, the order cannot be returned.
Once your order has been prepared by us, you will receive an email informing you that your items have been dispatched. You will then be able to track the status of your order using the tracking information contained in the email. If you do not receive an email (either confirming or dispatching your order), please contact us for further information.

We may have to cancel your order for a legitimate reason, for example :

– when you have been able to place an order but your product is no longer available: we will inform you of this as soon as possible and reimburse you as soon as possible;

– when a technical error occurs during payment;
– when an obvious error has crept into the product data sheet (for example, when there is an error in the essential characteristics of the product, or when an obviously incorrect price is displayed);
– when we observe fraudulent or abusive use of your account or related orders;

– when we reasonably believe that you have violated our Terms and Conditions of Sale.

3. OUR PRODUCT PRICES

The prices of our products are indicated on the Site in euros, all taxes included (VAT), excluding shipping costs (which will be specified when you choose your delivery method). They include Value Added Tax (VAT) and any discounts applicable to our commercial operations in force on the day of your order.
The Customer acknowledges and accepts that product prices may vary between the site and other sales platforms, and that under no circumstances may this price difference be used as a basis for a request for reimbursement, either total or partial (apart from your right of withdrawal applicable under the conditions set out below).

4. HOW TO PAY FOR YOUR ORDER

Payment for your order is made directly online by credit card or Paypal. You also have the option of paying in 4 instalments, free of charge, with Paypal for orders ranging from 20 euros to 2,000 euros (you will be charged monthly).
Once your payment has been confirmed by our payment service provider, your bank account or Paypal account will be debited for the total amount of your order (except for Paypal payment in several instalments, for which your bank account will be debited 4 times).
We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data with our payment service provider.
At no time do we have access to your personal data concerning your means of payment, in particular your credit card details, and we do not store them on our servers.

To do so, simply tick the “Save your payment details” box when you make your payment. In this case only, our payment service provider will store your data in encrypted form. You can delete the credit card you have registered either directly in your customer account under “My payment options”, or by e-mail.

5. DELIVERY OF YOUR ORDER

Where and how can your order be delivered?
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are shipped by La Poste via COLISSIMO, a tracked delivery service, delivered without a signature. Delivery times are given as an indication only; if they exceed thirty days from the date of order, the sales contract may be cancelled and the purchaser reimbursed. Léane Jacquot may provide the purchaser with a parcel tracking number by e-mail. The buyer is delivered to his home by his letter carrier. If the purchaser is absent, he/she will receive a delivery notice from the letter carrier, allowing him/her to collect the products ordered from the nearest post office, within a period of time indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of the company Léane Jacquot. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

When will your order be delivered?
When you place your order, we will inform you of the delivery time for your items. Please note that delivery times may be longer during peak periods (e.g. sales periods). Taking into account manufacturing times, orders will be dispatched between 5 and 10 days after the date of purchase.

6. HOW DO I RETURN, REFUND OR EXCHANGE MY ORDER?

Returning your personalized products :
Since our products are entirely personalized, they cannot be returned.

7. WHAT GUARANTEES DO YOU OFFER FOR YOUR PRODUCTS?

Our products are covered by legal guarantees, i.e. the legal guarantee of conformity and the guarantee against hidden defects. In our capacity as seller, we are effectively liable for :
1. for defects in conformity of the products you purchase, under the conditions of article L.217-4 et seq. of the French Consumer Code. The legal guarantee of conformity applies when your product presents a defect of conformity, for example when your product does not function in accordance with the uses to which it is usually put, or when it does not correspond to the description given;
2. and for hidden defects under the terms of article 1641 et seq. of the French Civil Code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. a defect that is not apparent at the time of sale, which renders the product unfit for its intended use, or which significantly reduces that use.
Please note that the legal warranty of conformity and the warranty for latent defects will not apply in the event of misuse of your products or failure to comply with the care instructions provided on our labels or by our alteration specialists.

If you make a claim under the legal warranty of conformity, you :

– have a period of two (2) years from delivery of the product to take action;
– may choose between repair or replacement of the product, subject to the cost conditions stipulated in article L.217-9 of the French Consumer Code;
– are exempted from having to prove the existence of the lack of conformity of the product during the twenty-four (24) months following delivery of the product, except for second-hand goods for which the period is six (6) months.
The legal warranty of conformity applies independently of any commercial warranty.
You may decide to invoke the warranty for latent defects under article 1641 of the French Civil Code. In this case, you may choose between rescinding the sale or reducing the purchase price in accordance with article 1644 of the French Civil Code.

9. LIABILITY AND FORCE MAJEURE

We undertake to describe the products we sell on the Site as accurately as possible, and to ensure that the information published on the Site is kept up to date as far as possible.
We shall not be held liable in the event of a breach of any of our contractual obligations resulting from a case of force majeure as defined by law. In particular, we shall not be held liable for any non-performance or delay in the execution of your orders caused by events beyond our control, such as :
– Strikes, closures or other industrial actions;
– Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation of war;
– Fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disasters;
– Inability to use rail, sea, air, road or other means of private or public transport;
– Inability to use public or private telecommunications networks;
– Acts, decrees, legislation, regulations or restrictions of any government (e.g. administrative closure of stores);
– Failure or accidents in maritime, postal or other transport.

The performance of the GTC will be suspended for as long as the force majeure lasts, and performance and delivery times will be extended accordingly. Please note, however, that we will do our utmost to put an end to the case of force majeure or to find a solution enabling us to perform our contractual obligations despite the case of force majeure.
